This Privacy Policy explains how we collect, hold, use, disclose and protect personal information when you visit www.titlenow.com.au, contact us or order a land title search, property plan or related property record.
We aim to handle personal information transparently and consistently with applicable Australian privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply to us.
1. What is personal information?
Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether or not the information is true or recorded in a material form.
Some property records may contain personal information about people other than the person placing the order, including registered owners, lessees, mortgagees or parties to registered interests. Those records are obtained from authorised property-information providers and registry systems and must be used only for lawful purposes.
2. Personal information we collect
The information we collect depends on how you interact with us and may include:

identity and contact information, such as your name, email address, telephone number and business name;

order and property information, such as the property address, state or territory, lot and plan, title reference, volume and folio, parcel details, products selected and order number;

transaction information, such as the amount paid, payment status, refund information, billing details and a payment-provider transaction reference;

communications, including enquiries, support requests, complaints, refund requests and other correspondence;

marketing preferences, including whether you have consented to receive marketing communications and any unsubscribe request;

We do not receive or store complete payment-card numbers. Card and digital-wallet payments are handled by the payment provider presented at checkout.

Dye & Durham and other property-information or registry-access providers so they can identify the property, submit searches and return documents;

state and territory land registries, government authorities and data custodians involved in fulfilling a search;

Wix and related website, hosting, customer-management and form providers used to operate the website;

payment and fraud-prevention providers, including Stripe where used at checkout;

email, document-delivery and customer-support providers used to send confirmations, links and communications;

analytics and advertising providers, including Google and Meta, where the relevant technologies are enabled;
-
professional advisers and service providers, such as accountants, solicitors, insurers, auditors, IT and cybersecurity providers;

a purchaser, investor or adviser involved in a genuine proposed sale, restructure or transfer of the business, subject to appropriate confidentiality and legal requirements; and

courts, regulators, law-enforcement agencies, government bodies or other parties where required or authorised by law or reasonably necessary to protect legal rights and safety.
We do not sell customer contact information or registry information as a marketing list. We do not permit personal information contained in a property record to be used for direct marketing, unsolicited contact, harassment, unlawful profiling, identity fraud or other unlawful purposes.
6. Property records and third-party personal information
Property records may contain names, addresses, ownership details and information about registered interests. We obtain these records to fulfil a specific customer order.
Customers must use supplied records in accordance with the Title Now Website Terms and Conditions, applicable law, and any conditions imposed by the relevant registry, data custodian or information provider.
If you believe a customer has misused personal information supplied through Title Now, contact us at info@titlenow.com.au. We may investigate, preserve relevant evidence, restrict access and refer the matter to a provider, registry or authority where appropriate.
7. Cookies, analytics and advertising technologies
Our website may use cookies, pixels, tags, local storage and similar technologies. These may be placed or operated by us or third parties, including Wix, Google and Meta.
These technologies may collect information about your device, browser, IP address, website activity, referrals, purchases or other interactions. We use them to:

Order confirmations, receipts, document-delivery messages, security notices and customer-support communications are transactional messages.
We will send marketing emails or messages only where we have consent or another lawful basis. Marketing consent is optional and is not a condition of purchasing a Title Now product. Marketing communications will identify the sender and include a functional unsubscribe method.
You can unsubscribe using the link in a marketing message or by emailing info@titlenow.com.au. We may retain a suppression record so that we can honour your request.
9. Overseas storage and disclosure
Some providers used to operate our website, process payments, deliver email, analyse website use or support advertising may store or process personal information outside Australia.
Depending on the providers and services in use, overseas locations may include the United States, Israel, countries in the European Economic Area, Singapore and other countries in which our service providers or their subcontractors operate. Provider locations and infrastructure can change over time.
Where applicable, we take reasonable steps to select reputable providers, limit information to what is reasonably necessary and use contractual, technical or organisational safeguards appropriate to the circumstances. Overseas recipients may be subject to the laws of their local jurisdiction.
10. Data security

Retention periods vary according to the type of information and the systems and providers involved. Download links may expire after the period stated in the order email. Expiry of a link does not necessarily mean that all associated order or transaction records have been deleted.
When personal information is no longer reasonably required, we take reasonable steps to delete it or de-identify it, subject to legal, technical, backup, dispute and record-keeping requirements.
12. Accessing and correcting personal information
You may ask to access personal information we hold about you or request correction if you believe it is inaccurate, out of date, incomplete, irrelevant or misleading.

We will respond within a reasonable period. In some circumstances, access or correction may be refused or limited where permitted by law. If so, we will generally explain the reason and available complaint options, unless it would be inappropriate or unlawful to do so.
Title Now cannot alter the underlying content of an official registry record. If your request concerns registry information, we may direct you to the relevant registry, provider or professional process.
13. Privacy complaints
If you have a privacy question or complaint, email info@titlenow.com.au and include:

the outcome you are seeking.
We aim to acknowledge a privacy complaint within two business days and investigate and respond within a reasonable period, having regard to its complexity.
If you are dissatisfied, you may ask for an internal review. If the Privacy Act applies to the matter, you may also be entitled to complain to the Office of the Australian Information Commissioner after first giving us a reasonable opportunity to address the complaint.
14. Data breaches
We will assess suspected data breaches and take reasonable steps to contain and address them. Where the Notifiable Data Breaches scheme or another notification obligation applies, we will notify affected individuals and the relevant regulator as required by law.
15. Third-party websites and provider policies
Our website may link to third-party websites and services. Their privacy practices are governed by their own policies, not this Policy. We encourage you to review the privacy information provided by Wix, Stripe, Google, Meta and any other relevant provider.
16. Children
