Can Anyone Order a Property Title Search in Australia?
Many Australian land-title registers are public registers, but access rules and search methods are not identical in every jurisdiction. In several states and territories, members of the public can order property-specific title information without being the owner.
Property search versus owner-name search
Searching a known property by address, lot and plan or title reference can be different from searching broadly by a person's name. Name searches may have additional access, identity or privacy requirements.
What information should you have?
The safest starting point is a specific property identifier. Check the returned legal land description carefully, particularly for units, rural properties and sites made up of multiple parcels.
Why access rules vary
Each state and territory operates its own system. The availability of a property search should not be taken to mean that every type of ownership or personal-name search is unrestricted.
Frequently asked questions
Do I have to own the property?
Property-specific title information is publicly searchable in several jurisdictions, but access methods vary.
Can I search every property owned by a person?
Owner-name searches can have different privacy, identity and access requirements.
Use the record for the right purpose
A title search is not a complete due-diligence report and does not establish a physical boundary on the ground. Separate planning, council, survey or legal enquiries may be needed depending on your purpose.
